Ten Year Sentence Given In Fatal DUI Case

As court documents allege, the suspect in a 2009 hit-and-run that killed a local motorcyclist had a blood alcohol content level of .236 percent, nearly triple the legal limit of .08 percent required to be considered impaired in the state of Florida. The 33-year-old man was driving the daughter of his fiancée to school that morning when he lost control of his vehicle.

The Toyota Avalon smashed at high speed into a motorcycle being driven by the victim, whose body was dragged for almost two hundred feet before the driver came to a stop. He panicked, got out of the car and fled the scene, leaving the nine-year old girl alone in the car until police arrived.

Judge Hands Down Heavy Sentence For Criminal

According to the prosecution, the driver was already sought by police in Maryland for violating his parole on a previous hit-and-run case in which he caused the victim serious injury.

The judge ruled that this showed a pattern of behavior and a lack of remorse for his actions. Convicted of DUI manslaughter and child neglect, the man was ordered to serve five years for the latter and ten for the former, sentences that will be served concurrently. Once his prison sentence is finished, the man will be on parole for an additional fifteen years, during which he will be banned from consuming alcohol.
