Lawsuits against Pfizer’s Lipitor

Pfizer, the maker of the anti-cholesterol drug Lipitor is now facing a growing number of personal injury lawsuits. The large number of lawsuits has been consolidated into what is called "multi-district litigation." Multi-district litigation consolidates complex product liability lawsuits so that they are handled by one court. By transferring all cases to one court, the legal process becomes more streamlined. In this case, Pfizer is being accused in the lawsuits of failing to warn consumers about the potential risk of developing diabetes associated with taking the statin Lipitor.
The company added a warning for the diabetes risk to its label in 2012. The lawsuit, however, asserts that the warning is too-little-too-late due to the fact that the drug has been approved, available, and widely prescribed since 1996 and, up until 2012, no warning at all existed for the millions of people taking the drug. The lawsuit also contends that the warning does not specifically state that the increased risk involves Type-2 diabetes. As an example, one of the plaintiffs was prescribed the drug in 2002 who later developed Type-2 diabetes and believes the drug has played a part in the development of the disease.
Lipitor has been a hugely popular cholesterol-lowering drug prescribed for those with a risk for heart disease. Since its approval, it has resulted in sales exceeding $125 billion for the drug company and has been listed as one of the top-selling pharmaceuticals in the world.
