Personal Injuries and Torts

By Jimmy Doan  Aug. 16, 2010 4:44p

The specific field of personal injury is based on harmful acts or failures to act for which the law recognizes and has remedies. These acts (harmful or negligent) are also called torts. There are many kinds of torts, a few examples would be:

  • Damaging or destroying a person's property
  • Damaging or destroying a person's character
  • Physically injuring someone
  • Unjustly denying a person his freedom or liberty

The basic concept in tort law is that if an individual is injured they should be compensated by the individual or entity responsible for the violation. The victim of the tort has the right to sue the offender for damages. A tort is actually considered a civil wrong against someone that subjects him to liability for the tort whereas a crime is a wrongdoing against society or the state and is punishable by imprisonment or monetary fine. Torts and crimes are sometimes confused, but they are considered separately. Some actions are both torts and crimes, in which case both liability and punishment can apply.

As an example, if you have been assaulted behind a bank while getting money out of the ATM machine and you were stabbed with a knife, per Texas law, you can file a civil suit for bodily injury (battery). Battery is also considered a misdemeanor crime for which a person can be imprisoned for up to one year and/or given a fine of up to $ 4,000. So the person who injured you can be held liable for his actions against you and can also be imprisoned and/or fined if convicted.
