Parents in San Francisco File Car Accident Lawsuit

In San Francisco, parents of a 5 year old boy filed a wrongful death lawsuit against a truck driver who crashed into and killed their son.  According to reports, the 5 year old had been crossing the street when the truck driver hit him. 

On February 27th, Zachary Cruz was crossing the street on the corners of Derby and Warring.  A kindergartner at LeConte Elementary School, Zachary was walking toward UC Berkeley's Clark Kerr Campus for an after-school program when the fatal accident occured.

The parents, Frank and Jodie Cruz, filed their lawsuit in Alameda County Superior Court in Oakland, California.  In their lawsuit, they named the truck driver, John William Martin Sr. as a defendant.  They also listed Martin's employer, Ferguson Welding Service, as a defendant along with the Berkeley Unified School District, school bus driver Zakiya Green, after-school program employee Zayda Arevalo and the University of California regents.

The lawsuit states that Zachary was dropped off by Green on Piedmont Avenue when Arevalo, who had been walking with other children, waved at the bus.  According to the lawsuit, the location at Derby and Warring was not a designated school bus stop.  Arevalo was crossing the street with Zachary and other young children when Martin hit the boy with his truck.

At this time, none of the defendants have issued responses regarding the lawsuit.
