The general damages

The general damages primarily compensate for the pain, the suffering, and the amenity loss which the victim has to deal with after the medical negligence.

The general damages can be calculated by comparing the injuries before and after the malpractice occured and also consulting the guidelines laid down by the Judicial Studies Board of the government. However, each case differs from one another and the compensations also depend on the severity of the injuries.

The special damages

The special damages can be calculated. They are quantifiable. Based on this, the required bills, receipts and other relevant documents need to be produced at the time of the court hearing. These all are the expenditures and financial damages which are on the patient’s expense. Typically such damages include loss of earnings, the medical treatment costs, the transportation fare to and from the hospital and other employment prospects in the forthcoming job avenues.

The interim damages

The interim damages in some cases of medical negligence may be paid out. The amount may be compensated before the case concludes and the verdict is given.

It is in effect to reimburse the claimant before the full amount will be paid. Such damages are only applicable in cases where the verdict has been ruled in the favor of the claimant. However, if there are hardships in any form, a defined financial sum can be given to help with any expense that needs to be addressed in the meantime.
