Parents Receive $11.4 Million For Child Brain Injury Lawsuit

The Associated Press is reporting that a jury recently awarded parents an $11.4 million dollar settlement after they filed a medical malpractice lawsuit on behalf of their child.  The trial lasted approximately three weeks before a jury decided to award a settlement to the parents of a brain damaged boy.

According to the lawsuit that was filed by the parents of the boy, the boy sustained a serious brain injury after receiving negligent care from a nurse and a nurse midwife in 2005.  The parents claim the negligent care was the cause of their son's permanent brain damage and filed a lawsuit to seek compensatory damages in 2006.

On October 17th, the jury presiding over the case sided with the parents and awarded the couple $11.4 million dollars.  Shortly after, the hospital that employed the nurse and nurse midwife released a statement that said the staff provided appropriate care and that the award was excessive.  However, the parent's attorney counters that the compensation is not enough to cover, "the life long medical care the boy will require."
