Can we file a lawsuit for a bad dog bite?

Details
My neighbor's spaniel bit my 4 year old pretty bad, and we had to take her to the emergency room to treat the puncture wound. The dog was out in the yard while our neighbor was gardening, and my daughter tried to pet it. Can we sue for medical costs even though my child went up to the dog first?

You may be able to file a personal injury claim against your neighbor, even if your daughter initiated contact with the dog. Pet owners have a responsibility to make sure their animals do not cause harm to others, and your neighbor could possibly be held liable for your daughter's injuries. It is best to speak with a knowledgeable attorney in your area who can investigate the accident and help you determine your legal options.
