A coalition of Florida insurance companies is seeking ways to stem the flood of what they consider to be frivolous or flat out fraudulent personal injury protection (PIP) insurance claims. With the advent of no-fault car insurance there has been a rise in the number of personal injury claims to max out the $10,000 in PIP insurance that all drivers must carry. According to those backing the Gear Up Florida campaign, frivolous and fraudulent claims have cost nearly $1 billion.
How to create effective reform?
While no one disagrees that fraudulent or unnecessary lawsuits need to be reigned in, provisions need to be made to ensure that those with valid claims are not made to suffer because of the actions of others. Ideas on how to reform the current system vary wildly. The Justice Association advocates that police at the scene of an accident be required to do a lengthier, detailed report for the insurance companies. They also suggest that whistleblower protection be granted for medical-care or health-care providers that report on fraudulent treatments that are being administered. The business coalition pushing for the changes is suggesting that more time be given to insurers when a claim is filed to do a more thorough investigation in determining if the claim is legitimate.
