Dog Bite Injuries

In Florida, a dog owner is liable for any damages that occur from his dog biting someone whether the incident happened in a public or private place (which includes the owner's home). If the victim of the dog bite was warned ahead of time, this liability can be reduced. If the dog causes damage to livestock or other domestic animals the owner can also be held liable as Florida law deems it the owner's responsibility to keep track of their dog and its actions. If the dog bites someone and causes severe damage, the dog may be quarantined for ten days at the owner's expense. In this type of case, the owner may also be charged with a crime and much harsher penalties can be carried out.

A dog can be labeled as a "dangerous dog" and may be confined. If it has been previously declared "dangerous" and bites someone without being provoked, it will be impounded and quarantined for ten days as well as destroyed unless a hearing determines otherwise. The exception to the rules above would be if a police or service dog bites someone, they would be exempt from the quarantine if they had an up to date rabies vaccination. Any dog bites that were received by a person who was committing a crime would also be exempt and would not be protected by the law.
