New York Police Brutality Incident Not Justified

By Hochheiser & Hochheiser LLP  Mar. 16, 2011 7:14p

Last year in January, three New York City police officers were placed on trial with charges of aggravated sexual abuse and cover up for sodomizing a suspect with a metal baton after spotting him smoking marijuana. The suspect ran down the street and into a subway when he spotted the officers and the attack occurred in the subway. Officers apparently threw him up against the wall, then the ground, kicked him in the head and proceeded to sexually assault him with the baton. He was then brought above ground and placed in the police car. Not long after, he was released and told to keep quiet, stay away from hospitals and was threatened with being charged with a felony if he violated the request.

Of the three officers who were involved, Officer Richard Kern was charged with aggravated sexual abuse and Andrew Morales and Alex Cruz were charged with cover up of the incident. Unfortunately, police can sometimes overstep their boundaries and misuse their power to inflict harm on others. When this occurs, they are not above the law and need to be held accountable. Corruption within a police department should not be tolerated in any city.
