Nebraska has had a wrongful death law since 1873. The statute allows for pecuniary losses only, which means losses of a monetary value. In Nebraska, only the decedent's personal representative who would be the executor of his or her estate can initiate a wrongful death claim. The claim on behalf of the surviving spouse or next of kin must be brought within two years of the death of the person.
