Nebraska Wrongful Death Law

Nebraska has had a wrongful death law since 1873. The statute allows for pecuniary losses only, which means losses of a monetary value. In Nebraska, only the decedent's personal representative who would be the executor of his or her estate can initiate a wrongful death claim. The claim on behalf of the surviving spouse or next of kin must be brought within two years of the death of the person.

A wrongful death is described under Nebraska law as being caused by "the wrongful act, neglect, or default of any person, company, or corporation." The wrongful act is an act for which the decedent would have been able to pursue damages if he or she had not died. The law was amended in 2003 to include the death of an unborn child.

Damages may include medical expenses incurred prior to the decedent's death, funeral and burial expenses, loss of the income the decedent would have provided, some damages related to pain and suffering, and loss of society, comfort, and companionship. Wrongful death claims are most commonly associated with auto accidents involving drunk drivers, drowsy or distracted drivers, drivers who ignore traffic laws, or who simply fail to pay attention. They may also stem from other types of accidents as well as medical malpractice, birth injuries resulting in death, defective products, a failure on the part of employers to meet safety standards, and other scenarios.
