What Classifies as a Wrongful Death?

By Clancy & Diaz  Nov. 13, 2010 5:55p

A wrongful death can be defined as the death of a person that resulted from the wrongful or negligent actions of another or others, and is basis for a lawsuit against the party or parties who are responsible for the death. Following are some examples of the type of deaths that can fall into this category:

  • Auto accidents
  • Medical errors
  • Pharmaceutical drug errors and negligence
  • An intentional attack (assault & battery)
  • Product malfunctions
  • Public transportation accidents
  • A death resulting while another crime was being committed
  • Vehicular manslaughter
  • Work related accidents (Employer failure to protect workers through correct safety measures)
  • Slip and fall injuries resulting from negligence
  • Animal attacks

Whatever the circumstances are involving a wrongful death, it will have to be proven that there was some sort of negligence or intent from another party which led to the death. Even if a person accidentally leaves the gate to their swimming pool open and a neighbor's child happens to wander in and drown, they could be charged with wrongful death. These types of death can be especially painful for the survivors as they are often quick and unexpected, leaving the family members grieving for the loss and often hurting financially.
