Driver Accused In Death Of Foreign Bicyclist

Defendant Ordered By San Francisco Judge to Stand Trial for Fatal Hit and Run

After an initial hearing in which he pled not guilty, an Oakland native accused of having been responsible for the tragic slaying of a German tourist almost a year previously was ordered to stand trial for his alleged crimes.

The victim, a 22-year old man from Berlin, was on vacation in the United States, staying in San Francisco. He was riding his bicycle southbound on Masonic Avenue near Turk Street on the night of August 13th, when he was struck forcefully from behind. His injuries proved fatal, and he died shortly thereafter.

Almost immediately after the collision, the driver sped away, fleeing from the scene of the crime, eyewitnesses reported. An emergency response unit arrived and attempted to revive the German victim, but he was unable to be saved.

Defense Attorney Argues Client Was Not Intoxicated

Given a description of the vehicle, an older Mercedes-Benz, law enforcement officers were able to apprehend the suspect only two blocks away from the accident. The 37-year old Oakland native was taken into police custody.

Nearly a year after the incident, he was present at the preliminary hearing for his case at the San Francisco Superior Court. There, he pled not guilty to the charges of driving while intoxicated, vehicular manslaughter, and leaving the scene of a crime. His defense lawyer claimed that, while his client had had a few drinks before driving, he was not intoxicated, nor had he shown any sign of impairment prior to the collision.

This claim was countered by the Assistant District Attorney prosecuting the man, who told the court that the defendant had had seven alcoholic beverages shortly before getting behind the wheel, and that he also was under the influence of marijuana at the time of the car crash.

Noting that police had not found any skid marks that might indicate the defendant had attempted to break at any time before the accident, the judge ordered the trial to continue. The next hearing will take place in early September.
