Parents Recieve Large Medical Malpractice Award

Although saddened by their son's diminished mental state, his parents are thrilled to have received the largest monetary award granted in a medical malpractice suit.

According to court documents, Dominic and Cathy D'Attilo brought Dr. Richard Viscarello to court after he delayed Cathy's cesarean section. As a result of this delay, their son was born with multiple serious injuries, along with being brain-damaged. Their son, now 8 years old, has cerebral palsy, and is unable to walk or talk. His condition is so severe that he cannot feed himself or sit up without assistance.

The D'Atillo's legal team, comprised of Kathleen Nasri and James Horowitz, determined that Dr. Viscarello did not provide the necessary care for their child in utero. Not only did he delay the cesarean sectin, Dr. Viscarello did not have a certified anesthesiologist or someone skilled in placing an endotracheal tube at the time of the pregnancy.
