Wrongful Death Claim Allowed to Move Forward Despite Bankruptcy Proceedings

This week, a federal bankruptcy judge has agreed to allow a wrongful death lawsuit against a former Pittsburg County Sheriff's lieutenant to move forward. 

Last year, the family of Stacey Pollard sued former Lt. Michelle Pollard in state court after a federal lawsuit was omitted.  Police say that Pollard's husband drowned in a pool in the backyard of the couple's home in 2005.

The attorney for the family, David Sutton, says Pollard had filed for bankruptcy last year as the suit was about to be heard.  He believes that due to the bankruptcy proceedings the lawsuit should have been blocked.

However, Thursday morning, a federal bankruptcy judge granted a lift a stay.  This allows Pollard to be tried in the wrongful death action.  Sutton told new sources his next step is to get the civil case put onto the calendar.

Last Summer, Pollard resigned several days before her indictment on obstructing justice charges.  Last month, she was released from prison after serving six months in jail for her conviction.
