Man Convicted of Vehicular Homicide Faces Wrongful Death Lawsuit From Slain Victim's Family

Kansas--A man convicted of vehicular homicide and leaving the scene of an injury accident will face a wrongful death lawsuit by the father of the slain victim.

Ryan Kanost was 22 when he was hit and killed by Joshua Walton in a hit and run accident in September 2006. Ryan's father, Michael Kanost, is seeking more than $75,000 in damages from Walton for expenses relating to his son's death and other losses, such as mental anguish and pain and suffering.

Michael Kanost claims Walton was acting in a "negligent, reckless, and wanton manner without regard for the safety of others" when he struck and killed his son.

According to an article on LJWorld.com, the wrongful death lawsuit, which was filed with the courts on September 16, accuses Walton of "driving too fast for the conditions, speeding, failing to keep a proper lookout, driving inattentively, driving recklessly, failing to yield the right-of-way to pedestrians, driving while under the influence of alcohol and/or drugs, and leaving the scene of an injury accident without rendering assistance or contacting authorities."

Walton hit Kanost in the early morning hours of September 23 when Kanost was walking across Kentucky Street. After hearing that Kanost had been killed, Walton contacted the police authorities the next day.

Walton was convicted of vehicular homicide and leaving the scene of an injury accident in February 2008. On March 24th he was sentenced to 90 days in jail and two years of supervised probation.
