Family of Trampled Wal-Mart Worker File Wrongful Death Lawsuit

According to news sources, the family of the temporary worker who was trampled to death in a Long Island Wal-Mart is filing a wrongful death lawsuit against Wal-Mart.  The death occurred last Friday, on "black Friday", when over-anxious shoppers stormed through the Wal-Mart, trampling and injuring workers.  The family is also listing the company who provides security for Wal-Mart as a co-defendant in their lawsuit.

The lawsuit was filed on December 3rd in the New York State Supreme Court in Bronx by the family of Jdimytai Damour.  Damour died of asphyxiation after 2,000 people trampled him on November 28, 2008.  The shoppers were lined up outside of the popular retail store for the pre-down sale the day after Thanksgiving.

In the wrongful death lawsuit, the family alleges that the death was avoidable and was caused by carelessness, recklessness and negligence on behalf of Wal-Mart Stores, Inc., the shopping center Green Acres Mall, LLC, its owner Vornado Realty Trust and Securitas Services USA, Inc.  Additionally, the lawsuit alleges that the store attracted a large crowd and created "an environment of frenzy and mayhem".  The family argues that the defendants failed to take appropriate measures for overcrowding, failed to provide adequate security and failed to implement a crowd-management plan, all of which contributed to Damour's traumatic death.

Lawrence Mulvey, the Nassau County Police Commissioner, agreed with the family by reporting that Wal-Mart had insufficient security to handle a crowd of that size.
